Terms of Use

These terms are the agreement between you and Valeriia Krysak ("we", "us") for the Packly app. Downloading or using the app means you accept them. If you do not, do not use the app.

Apple is not a party to this agreement. We, not Apple, are responsible for Packly and everything in it. Nothing here overrides the App Store Terms of Service — where the two conflict, Apple's terms win.

1. The app

Packly is a deck of conversation prompts for two people, published for Apple mobile devices. It is entertainment, not therapy. It is not a medical device, not counselling, and not a substitute for professional help with your relationship or your mental health. If you are in distress, contact a qualified professional or your local emergency services.

You must be 18 or the age of majority where you live to buy a subscription.

2. Your licence

We grant you a personal, non-exclusive, non-transferable licence to install and use Packly on Apple devices you own or control, as permitted by the App Store Usage Rules, including through Family Sharing where Apple allows it. This licence covers updates unless an update comes with its own terms.

You may not sell, rent, lend, sublicense or otherwise redistribute the app; reverse engineer, decompile or disassemble it, or try to derive its source code, except to the extent the law says you may despite this restriction; or remove any proprietary notices. All rights not granted here stay with us.

The card questions, the artwork, the name and the app itself are ours and are protected by copyright and trademark. Reading the cards to your partner is what the app is for. Republishing the packs — as a product, a deck, a post or a dataset — is not.

3. Subscriptions

Some packs and features require a paid subscription. If you buy one:

Purchases are made through Apple, so refunds are handled by Apple under its own policy — request one at reportaproblem.apple.com. Except where the law requires otherwise, payments are non-refundable and we do not give partial refunds for an unused part of a period.

4. Requirements and availability

Packly needs a supported version of iOS and an internet connection to download card packs and to check your subscription. Checking that your device meets those requirements is your responsibility. We try to keep the app working with new iOS releases, but we do not promise any particular update, and we may change or discontinue features. If we discontinue the app entirely, we will not renew subscriptions beyond the periods already paid for.

5. Your content

Packly does not ask you to post anything, and there is nowhere in it for other users to see what you write. The names you enter during setup stay on your device. Your answers to the cards are spoken to your partner and never leave the room. If you send us feedback or a suggestion, we may use it to improve the app without owing you anything for it.

6. Acceptable use

Do not use Packly to break the law, to harass or coerce anyone, or to interfere with the service or with anyone else's use of it. Do not attempt to access our systems or data without authorisation. We may suspend or end your licence if you do.

7. Privacy

What the app collects, and what it deliberately does not, is set out in our Privacy Policy, which forms part of these terms.

8. Support

We provide support on a reasonable-efforts basis at hello@packly.date; see the support page. Apple has no obligation to provide any maintenance or support for Packly.

9. Warranties

We warrant that, at the time you download it, Packly is free of malware and works substantially as described. Beyond that, and to the fullest extent the law allows, the app is provided "as is" and we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error-free.

This warranty does not cover an app that has been modified, jailbroken, combined with unsuitable hardware or software, or otherwise handled in a way outside our control.

If Packly fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits your statutory consumer rights.

10. Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, data or goodwill, arising from your use of Packly. Our total liability for any claim relating to the app is limited to the amount you paid us for it in the twelve months before the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

11. Claims

We, and not Apple, are responsible for addressing any claim from you or a third party relating to Packly, including product liability claims, any claim that the app fails to meet a legal or regulatory requirement, and claims under consumer protection or privacy law. We, and not Apple, are responsible for investigating and resolving any third-party claim that Packly infringes intellectual property rights.

12. Apple as third-party beneficiary

Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, Apple has the right to enforce them against you.

13. Export and sanctions

You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government list of prohibited or restricted parties.

14. Termination

This licence lasts until it is ended by you or by us. It ends automatically if you break these terms. You may end it at any time by deleting the app — remembering that deleting the app does not cancel a subscription. Sections that by their nature should survive termination do so.

15. Changes

We may update these terms. When we do, the date at the top changes and material changes are announced in the app. Continuing to use Packly after a change means you accept the updated terms.

16. Governing law

These terms are governed by the laws of Ukraine, without regard to its conflict of law rules, and the courts of Ukraine have jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in, or of the right to bring proceedings there.

17. General

These terms, together with the Privacy Policy, are the whole agreement between us about Packly. If a provision is found unenforceable, the rest stays in force. Not enforcing a right is not a waiver of it. You may not transfer these terms; we may transfer them to a successor of our business.
